NICE Recovery Return & Warranty Policy Effective Date 1 June 2025
Return Policy
Thank you for shopping with NICE Recovery. We are committed to ensuring satisfaction with your purchase and understand sometimes a product may need to be returned. Should you need to initiate a return, please note that all returns are subject to the terms outlined below.
This Return Policy applies to all NICE Recovery products purchased directly from NICE Recovery Systems LLC or through an authorized reseller. It does not apply to items clearly marked as “Final Sale” or “Non-returnable” on the product listing page.
Definitions
· Delivery Date: The date the carrier records as delivered to customer
· Like-new condition: No visible wear, all
original seals intact, all accessories present, and packaging undamaged.
· RMA: Return Merchandise Authorization document issued by NICE Recovery.
· Seller: NICE Recovery Systems LLC (“Seller”) or authorized reseller
· Buyer: purchaser or end-user as permitted (“Buyer”)
Return Process
Returns must be initiated within 30 calendar days of Delivery Date. RMA and return label are valid for 14 days from issuance.
To begin a return, please submit a ticket at getnice.com/service-request or contact customer service at support@getnice.com. Order number, item(s) for return, and reason for return will need to be provided.
Products must be returned in like-new condition, with original packaging and accessories in addition to a valid RMA provided by Seller.
The following are ineligible for return:
· Products altered or serviced by unauthorized
parties
· Damage from misuse, accident, neglect, inconsistent storage or use
· Use in unintended applications or environments
· Defects occurring during shipment not caused by Seller
· Products marked final sale on their product page
· Refurbished devices
Returned products are subject to inspection against “like-new” criteria. If approved by Seller (as determined in its sole discretion), a full refund (excluding original shipping & restocking fees) will
be issued to the original payment method within ten to fifteen (10-15) business days after the item is received and inspected by Seller. It can take one to two billing cycles depending on payment used and the practices of your financial institution to receive credited refunds.
Excessive returns may trigger account review or rejection of future returns. Seller reserves the right to refuse returns suspected of fraud.
Seller may update this policy at any time; the “Effective Date” above reflects the current version. This Return Policy is governed by the laws of the State of Colorado. Disputes must be filed in State or Federal Court in Boulder County Colorado.
Warranty Policy
This Warranty Policy covers manufacturing defects in materials or workmanship. It applies only to products purchased directly from Seller or through an authorized reseller.
Seller warrants that all products are free from material defects for twelve (12) months from delivery or as stated in the Manufacturer’s Warranty in the Product User Manual, whichever is longer. Accessory Products (e.g., therapy wraps, power supplies) hold a 90 day warranty term, subject to change at Seller’s discretion. Warranties transfer to Buyer only and not to a third-party sale made by Buyer.
Seller’s sole obligation and Buyer’s exclusive remedy for breach of this warranty is, at Seller’s discretion, repair or replacement of the defective Product.
To initiate a warranty claim, contact customer support as outlined in Return Process.
Replacement items inherit the remaining term of the original warranty and do not create a new period.
Repair or replacement for valid warranty claims will occur at no cost and shipping costs for warranty service will be covered by Seller. Costs may occur if warranty claim is found to be invalid.
Limited Warranty Periods
· Devices – 1-Year Warranty
· Devices (UK/EMEA) - 2-Year Warranty, unless otherwise stipulated by mutual business agreement.
· Attachments and Accessories – 90-Day Warranty*
*Please note that accessories include therapy wraps, power supplies, removable components of the
devices, adapters, and carrying cases.
Warranty Exclusions
This warranty excludes:
· Products altered or serviced by unauthorized parties
· Damage from misuse, accident, neglect, inconsistent storage or use
· Use in unintended applications or environments
· Defects occurring during shipment not caused by Seller
· Products determined by Seller to be counterfeit, falsified, or diverted from authorized distribution channels
· Normal wear & tear or cosmetic damage
· Products purchased from unauthorized resellers
· Consumable parts
· Failure due to unauthorized third-party attachments
· Damages caused by Buyer
Devices suspected of being counterfeit will not be eligible for warranty coverage and may be reported to applicable health authorities, in accordance with regulatory obligations.
Limitation of Liability
Seller’s liability is limited to repair or replacement under this warranty policy. Seller shall not be liable to the Buyer for any indirect, incidental, special, exemplary, or consequential damages, or damages for loss of profits, revenue, or lost business opportunities, incurred by Buyer, whether in an action in contract or in tort, even if such party has been advised of the possibility of such damages. In no event will Seller’s liability or damages hereunder exceed the amount paid by Buyer under this Agreement. This limitation applies to all causes of action in the aggregate including without limitation to breach of contract, breach of warranty, negligence, strict liability, misrepresentations, and other torts.
Consumer Rights
This warranty is in addition to any rights under local consumer protection laws. Where local law provides greater protection, those rights prevail.
